Performance rights and script terms for plays written by Tom Erb
This schedule outlines the standard terms under which ERB Publishing licenses the performance rights and scripts for plays written by Tom Erb. These terms apply to amateur and community theatre productions unless a separate written agreement is negotiated directly with ERB Publishing.
Scripts are sold at $20.00 per copy. Producing organizations are responsible for purchasing one script per cast member, plus copies for the director, stage manager, and any other production staff who require one. Scripts may not be photocopied or reproduced in any form.
ERB Publishing offers a simplified royalty structure designed to make producing multiple titles more accessible to schools and community theatres.

The first play a producing organization licenses in a given production carries no performance royalty, only the cost of scripts. If that same organization licenses additional ERB Publishing titles — whether performed in repertory, as part of a festival, or across a season — each additional title is licensed at a flat fee of $50.00, regardless of the number of performances.
Performance rights must be requested and confirmed in writing before any rehearsal, performance, or promotional announcement.
Please include the following with any request:
- Title of the play
- Producing organization name and contact information
- Performance dates and venue
- Anticipated number of performances
- Number of scripts needed
- Rights are granted for a single production and run at a single venue unless otherwise specified in writing.
- No changes may be made to the script, including cuts, additions, or changes to character gender or setting, without prior written approval from ERB Publishing.
- Billing and programs must credit the play as written by Tom Erb and published by ERB Publishing.
- Video or audio recording of performances for archival or promotional use requires separate written permission.
- Rights fees are due prior to the first performance unless other arrangements have been confirmed in writing.
